Los Angeles Dodgers file for bankruptcy protection (AP)

LOS ANGELES ? Facing the painful prospect of stiffing players and employees, the Los Angeles Dodgers filed for bankruptcy protection in a Delaware court Monday, adding to off-the-field troubles that have hobbled one of baseball's most storied franchises and setting up another showdown with Major League Baseball.

Team owner Frank McCourt, upset baseball Commissioner Bud Selig rejected a multibillion-dollar TV deal last week, now hopes a federal judge will approve $150 million in financing to be used for daily operations and give him more time to seek a more favorable media contract. A hearing is set for Tuesday.

The move by a cash-starved McCourt comes just days before he was expected to miss team payroll Thursday and possibly be confronted with an MLB takeover. The filing also means it's unlikely a resolution over team ownership, a fight that began two years ago when McCourt and his ex-wife and former team CEO Jamie McCourt decided to divorce, will be found any time soon.

Selig said in a statement that the bankruptcy filing has inflicted further harm upon the Dodgers.

"We have consistently communicated to Mr. McCourt that any potential solution to his problems that contemplates mortgaging the future of the Dodgers franchise to the long-term detriment of the club, its loyal fans and the game of baseball would not be acceptable," he said. "To date, the ideas and proposals that I have been asked to consider have not been consistent with the best interests of baseball."

Legal observers expect MLB to contest McCourt's request for filing bankruptcy, arguing the dispute should remain within the confines of baseball and the league's constitution allows Selig to take control of a team that seeks Chapter 11 protection.

The main issue is whether "the bankruptcy court maintains control of the proceedings or acquiesce to baseball," said Edward Ristaino, who chairs the sports practice at the law firm Akerman Senterfitt. "The courts recognize the special interests of the commissioner and give him great deal of deference. My sense is that won't happen very quickly at all."

In court documents, team Vice Chairman Jeff Ingram cited a significant drop in attendance, contributing about 10 percent of Dodger revenues to the league's sharing program last year and paying about $22 million in deferred compensation as reasons for filing bankruptcy.

"To date, LAD has remained current in its obligations," Ingram wrote. "However, LAD is now on the verge of running out of cash, the results of a perfect storm of events."

McCourt has taken out loans to stay afloat this season but his mounting financial problems were expected to balloon this week, when he owed tens of millions of dollars to meet payroll and other obligations.

About $20 million is slated for current and deferred compensation by Thursday, while more than $18 million is required as a reserve to prefund money to be paid to players in 2012 under terms of the collective bargaining agreement, court documents show.

The bankruptcy filing also noted a $67 million loan taken out against the parking lots at Dodger Stadium was set to mature on Thursday. It was expected McCourt was going to refinance the loan.

"He's clearly running very low on options right now," said David Carter, executive director of USC Sports Business Institute. "What seems to be the case is a high-stakes chess game between Frank McCourt and MLB, and he's running out of pieces. This is one of the uglier weeks in Dodger history."

Among the 40 largest unsecured claims, totaling about $75 million, are former Dodgers slugger Manny Ramirez at nearly $21 million; Andruw Jones at $11 million; pitcher Hiroki Kuroda at $4.4 million; and the Chicago White Sox, which share a spring training facility with the Dodgers in Arizona, at $3.5 million. Longtime Dodger announcer Vin Scully is owed more than $150,000 as part of his contract, court documents show.

Dodger officials said they reached out to numerous banks and investors and while several parties expressed interest in providing financing, they received only one commitment from Highbridge Principal Strategies. If approved by a judge, the financing would come in two chunks from the investment firm ? $60 million up front with the remainder being paid at a later date.

Tripp Kyle, a spokesman for the firm, declined to comment about the reasons the company decided to lend McCourt the money.

"The rule or ruin philosophy that appears to have motivated today's filing is bad for everyone who cares about, or has an interest in, the Dodgers," David Boies, an attorney for Jamie McCourt, said.

McCourt has defended his running of the team, saying he had made it profitable and successful. He also said the Dodgers have tried for almost a year to get Selig to approve the Fox transaction, which would have provided McCourt with $385 million up front and was vital to a binding settlement reached earlier this month by him and Jamie McCourt.

"He's turned his back on the Dodgers, treated us differently, and forced us to the point we find ourselves in today," McCourt's statement said. He was not made available for further comment Monday.

Bob Daley, who was managing partner of the Dodgers when News Corp. owned the team, said Monday that McCourt had been "an embarrassment to this franchise."

"Fox, myself, and MLB made a horrible mistake in not doing the proper due diligence on Frank McCourt," Daley said. "I helped get him approved and for my piece, I feel very bad about it."

The McCourts have been embroiled in a contentious divorce where their lavish spending habits were detailed in court documents. The former couple took out more than $100 million in loans from Dodger-related businesses, records show.

In April, MLB took the extraordinary step of assuming control of the troubled franchise. Former Texas Rangers President Tom Schieffer was appointed to monitor the team on behalf of Selig, who said he took the action because he was concerned about the team's finances and how the Dodgers are being run.

The Dodgers' filing follows the Rangers, who sought Chapter 11 protection in May of last year. The Rangers' filing successfully pushed through Hall of Fame pitcher Nolan Ryan's $590 million bid to buy the team. Creditors had stalled the deal for months, arguing that the team had rejected higher offers.

The divorce settlement, now voided because of Selig's decision, called for a one-day "characterization" trial Aug. 4 to determine if title to the Dodgers is in Frank McCourt's name or if the team should be considered community property and sold. Robert Sacks, an attorney retained by Frank McCourt, said the trial may be shelved and Superior Court Judge Scott Gordon could decide how to handle the former couple's assets at a later date.

Gordon ruled in December that a postnuptial marital agreement that gave Frank McCourt sole ownership of the Dodgers was invalid. That cleared the way for Jamie McCourt, who served as the team's CEO and was fired by her ex-husband two years ago, to seek half the team under California's community property law.

Schiele painting goes for record £25 million at London sale (AFP)

LONDON (AFP) ? A monumental cityscape painting by Austrian artist Egon Schiele on Wednesday smashed the world record after it was sold for ?25 million at a London auction.

"Haeuser mit bunter Wasche (Vorstadt II)" (Houses with Laundry (Suburb II)) eventually went under the hammer at Sotheby's auction house for ?24,681,250 ($40 million, 27.6 million euros), almost double the previous auction record for the artist.

The 1914 oil painting is "loosely based on motifs drawn from Krumau", the Southern Bohemia town in which the artist's mother was born and which inspired some of his greatest works, Sotheby's said.

Proceeds from the sale of the work, completed four years before the artist died aged 28, will go towards resolving a long-running dispute over an art work stolen by the Nazis.

A US court last year ordered Vienna's Leopold Museum, which owned the auctioned painting, to pay $19 million to the heirs of Lea Bondi Jaray, a Jewish art dealer who owned another of Schiele's paintings before it was taken by Nazi Friedrich Welz.

"Portrait of Wally" eventually found its way into the hands of the museum, which decided to sell Haeuser mit bunter Wasche to fund the compensation claim, keeping hold of the disputed work.

Peter Weinhaupl, Managing and Finance Director of the Leopold Museum, said: "We are extremely pleased with the results Sotheby's has achieved" and added it would "allow the museum to move forward with its goals."

The previous auction record for a Schiele oil on canvas was $22,416,000, realised in 2006.

Overall, Tuesday's sale achieved ?96,968,000 with a sculpture by Alberto Giacometti going for ?10,681,250.

Three works by Pablo Picasso, each depicting a different one of the Spanish artist's lovers, sold at a London auction on Tuesday for a total of 42 million pounds.

Medvedev speech: nod or challenge to Putin's upper hand? (The Christian Science Monitor)

Moscow ? Political competition is always a good thing, Russian President Dmitry Medvedev said Monday, but the much-discussed idea of an open presidential face off between himself and his powerful predecessor, Prime Minister Vladimir Putin, would be bad for the country.

Mr. Medvedev's comments, made in an extensive interview with Britain's Financial Times newspaper just days after challenging the state-led system built by Mr. Putin at an international economics forum, has many observers scratching their heads about his intentions.

"I think that any leader who occupies such a post as president, simply must want to run," Medvedev said. But, he added, "the people must provide an answer to this one. They define whether they want to see this person or not and, as an acting politician, I will be guided by that in taking my decision. I think that we will have not very long to wait and I think that the decision will be correct, both for the rest of the federation and myself."

Analysts say it's difficult to see how "the people" could give such a signal in Russia's top-down and heavily controlled political system.

"Between the lines, it's clear Medvedev is saying that Putin will decide," says Alexei Mukhin, director of the Center for Political Information, an independent Moscow think tank. "He keeps being asked this question, about whether he will run, and tries to find ways of talking about it without providing an answer. The fact that he can't say 'yes' or 'no' at this point means the decision almost certainly depends on somebody else."

Putin, who leads the ruling United Russia party, increasingly looks to be running for a six-year presidential term in polls slated for next March, though he's made no explicit announcement.

But he might already be able to claim that the people have given him a sign. Last month, Putin announced the creation of a popular front whose main purpose appears to be backing Putin's renewed bid for national leadership. Medvedev has consistently sounded far more liberal than Putin on economic and political issues. Many people see Medvedev's speech last Friday to the St. Petersburg economic forum as a liberal election manifesto to challenge the conservative "stability first" approach championed by Putin.

In his St. Petersburg speech Medvedev explicitly attacked the state-led model of economic development introduced by Putin. "The result is state-controlled companies dominating many sectors, low levels of entrepreneurial and investment activity in these sectors, and ultimately, the threat that Russia?s economy will become less competitive in general. This economic model jeopardizes the country?s future. It is not my choice," Medvedev said.

As he has in the past, Medvedev suggested that Russia needs top-to-bottom "modernization" to turn it into a 21st-century economic powerhouse. Among other things, he called for accelerated privatization of key state assets, decentralization of political power, judicial reform, crackdown on corruption, and visa-free travel between Russia and Europe.

But when asked by the Financial Times whether he would consider running against Putin in an open electoral contest that would enable the Russian people to choose between his vision and his predecessor's, Medvedev's answer was clearly no.

"It is hard to imagine," he said. "The thing is that Vladimir Putin and myself ??? and Vladimir Putin is my colleague and an old friend ??? we represent, to a large extent, one and the same political force. And therefore, competition between us may be detrimental to those tasks and goals that we???ve been pursuing in recent years. Therefore, I think this would not be the best scenario for our country and for this specific situation."

Some analysts say they're growing weary of what looks like a stage-managed political spectacle aimed at creating the impression of public choice between Medvedev and Putin, while the actual decision will be made behind closed Kremlin doors on a timetable of Putin's choosing.

"After three years of a Medvedev presidency, we see no real changes in this country," says Sergei Strokan, a columnist with the liberal Moscow daily Kommersant, noting that Medvedev's frequent bursts of rhetorical reformism are seldom translated into action.

"If Medvedev had real political ambitions of his own, he should have expressed them openly, honestly, and assertively by now. But what we see is a polite gentleman, who smiles and gives good speeches, which are mainly meant for consumption in the West," he says.

"It's beginning to look like he only makes these speeches to save his own face. If he's on his way out, I guess he'd rather go looking like a reformer than like a puppet."

The Story: First To Last, Part 3: The evolutionaries continue to attack and we see, through emerging memories, the origin of the evolutionaries. At the same time, their last visit is further illuminated, while their fight to take out Cyclops continues.

What?s Good: This issue had several eye-opening (or popping, depending on how unjaded you are) reveals that were quite cool. Our no-spoiler policy keeps me from enthusing, but I?m definitely going to reread this issue, not because I missed something, but because the implications are thick enough to reward another look. I got the impression that Yost was having fun with his characters in this issue, which colored the overall feel. Old Ice Man, Wolverine, Old and New Cyclops, and Old Beast all showed their little personality quirks and the sum is so much more than a patchwork of familiar reactions. There?s a soap operatic social web of friendships, tensions, conflicts and overt and hidden respects that has been a trademark of Marvel since Spiderman was created, and brought to a much higher levels by such X-masters as Claremont. Yost is drawing on that wealth to create sitcom-esque joisting, double meanings or clever ambiguities. Although I loved the original X-Men moments in this issue, my favourite scene was where all the young mutants are ?keeping? Cyclops safe and he flatly says ?I?ll give you one more minute, then I?m leaving.? In response, Rockslide asks, ?You think you can take all of us?? and Cyclops just answers ?Yes. You?ll be first.? You can totally sympathize with this adolescent powerhouse being intimidated by a leader whose position is becoming increasingly legendary. And the reader shares Rockslide?s awe when you think ?Yeah, Cyclops can be knocked unconscious with the leg of my dining room table, but shit?what trick has this strategic genius got that he?s not even a little scared of Rockslide and half a dozen other mutants??

Medina, Talajic, Medina, Vlasco, Garcia and Quintana turned in some delightful visual candy. The workshop of Phastus was cool, while the double-splash page of Storm and Magneto fighting the evolutionaries was powerfully set up. The modern-day fight scenes were all clear and evocative, but the real charm for me was in visiting the X-Men?s past and seeing both the X-Men and the original Brotherhood of Evil Mutants, as the were in their innocent youth. Whereas now all of them are stylishly suited, Talajic and Gracia dug deeper into the well of real Marvel history to show how awkward and ill-fitting their first costumes were (presumably before Reed Richards? unstable molecules were widely used). The older, darker color palette for the scenes in the past was also a very powerful tone-setting device that served the entire creative team well.

What?s Not So Good: Honestly, I?m loving this story. When I first finished reading, my brain was grasping a bit for what events had filled the pages. The reason I felt that way was because although there?s action, this was a book or revelations in a mystery story. The texture deepened. But that doesn?t constitute a failing.

Conclusion: X-Men #13 is fascinating reveal after fascinating reveal. Yost has a firm hand on the steering wheel on this one and I?m loving everywhere he?s taking us.
