Cheat sheet for Michael Jackson doctor's trial

More than two years after Michael Jackson's death, the biggest question of all is about to be answered.

At least, we sure hope it's going to be answered.

Opening statements are set to begin Tuesday in the city of Los Angeles' involuntary manslaughter case against Dr. Conrad Murray, a Houston-based cardiologist who is accused of administering an overdose of a surgery-grade sedative that killed Jackson on June 25, 2009.

The trial is expected to last at least five weeks, but we'll have you fully informed in five minutes with our handy Jackson trial cheat sheet.

The Charges
Murray is charged with one count of involuntary manslaughter, which, in California, is an unlawful killing that takes place either during the commission of an unlawful non-felony act, or during the commission of a lawful act that involves a high risk of death or great bodily harm that is committed without due caution or circumspection. If convicted, Murray faces a maximum of four years in prison, the loss of his medical license, up to $10,000 in fines and formal probation. The doctor, who is currently barred from practicing medicine in California, has pleaded not guilty.

The Defendant
Murray had been employed for a short time as Jackson's personal physician, having been hired by AEG Live, which was producing Jackson's This Is It concert series, to the tune of $150,000 a month. After Jackson's death, Murray claimed that he hadn't yet been paid for any of his services. The doctor, who kept offices in Houston and Las Vegas, was revealed to be in dire financial straits and was behind on child support payments. Since his arrest in February 2010, Murray has been free on $75,000 bail and has pleaded not guilty to involuntary manslaughter.

The Defense
Murray claims that he had been trying to wean Jackson off of the anesthetic propofol, which the pop icon had been using regularly to get to sleep. Despite witness statements to the contrary, Murray says that only about 10 minutes passed between the time he discovered Jackson unconscious and the time he called 911. His legal camp, headed up by Texas-based counselor Edward Chernoff, is prepared to argue that Jackson injected himself with the fatal dose of propofol. In order to represent Murray, Chernoff took the California Bar Exam. His cocounsel are L.A.-based Michael Flanagan and Nareg Gourjian.

The Prosecution
Deputy District Attorneys David Walgren and Deborah Brazil, 16- and 15-year veterans of the L.A. County District Attorney's Office, will argue that Murray was negligent in his treatment of Jackson and that his carelessness and bad judgment resulted in the singer's death.

The Judge
L.A. Superior Court Judge Michael Pastor, named Judge of the Year in 2007 by the L.A. County Bar Association, is one of only 10 judges in the entire Superior Court system designated to preside over "complex criminal litigation." He is allowing cameras in the courtroom and refused the defense's wish to sequester the jury for the duration of the trial, calling it an unnecessary burden on the jurors. Just today, Pastor ruled that video of Jackson's final press conference will not be shown during the trial. Murray's attorneys had claimed that Jackson appeared to be "under the influence" in the video and was prepared to scale back his planned concert schedule from 50 to 10 dates.

The Jury
Seven men and five women have been sworn in, with Flanagan saying Friday, "It seems like a good jury panel." There are also five alternates. In deciding not to sequester them, Pastor noted that the jury would be subject to "very strict rules and regulations."

When asked this past February on TODAY if she still believed Murray was culpable, she replied, "Mmm-hmm. And that's all I'm going to say. I do. I really do."

Witnesses
Walgren has said that he plans to call witnesses chronologically, starting with the those who were working with Jackson in the months before his death and ending with law-enforcement and medical experts who analyzed the aftermath. After opening statements have been made, first up will be choreographer and This Is It director Kenny Ortega, who testified at a previous hearing that Murray had advised him not to worry about Jackson's health. Ortega is expected to be followed by AEG Live's Paul Gongaware.

Also on the docket are Jackson bodyguard Alberto Alvarez and Las Vegas pharmacist Tom Lopez, who previously stated that he shipped large amounts of propofol ? prescribed by Murray ? to Jackson's home in the weeks leading up to his death. Jackson's eldest son and daughter, who were at home when live-saving efforts were made on their dad, are not on either side's list of potential witnesses. Otherwise, the entire Jackson family has made the prosecution's list.

    She went on to tweet: "Boycott SouthwestAir if you are gay. They don't like us."

    Hailey, who starred on Showtime network's "The L Word" as Alice, a bisexual magazine writer and radio host, also demanded a public apology.

    The airline issued a statement saying initial reports it received about the incident "indicate that we received several passenger complaints characterizing the behavior as excessive."

    "Our crew, responsible for the comfort of all customers on board, approached the passengers based solely on behavior and not gender," the airline said. "The conversation escalated to a level that was better resolved on the ground, as opposed to in flight."

    The statement concluded: "We regret any circumstance where a passenger does not have a positive experience on Southwest and we are ready to work directly with the passengers involved to offer our heartfelt apologies for falling short of their expectation."

    An airline spokesman declined to comment beyond the prepared statement.

    The incident comes a little over three weeks after another celebrity, Green Day rocker Billie Joe Armstrong, was complained he was booted from a Southwest flight in Oakland, California, because he was wearing his baggy pants too low.

I don?t think this is the bad part. Our government is important to our way of life, and what it provides isn?t free. The problem is that so many people don?t realize this, or don?t value our government (conservatives) and they?ve successfully lobbied against taxes and for lowering them for since the ?70s. Now we have a $15 trillion debt because we didn?t stop spending, just quit bringing in enough revenue.

    Conservatives are sure they know how people should act, based on some convoluted interpretation of their holy book, which they?ve never actually read in its entirety, or some other equally bankrupt reasons, like ?Common Sense? or ?Gut Feelings?. So they pass laws that deny civil rights, which lead to awful unintended consequences like Al Capone of Prohibition (more examples? Try searching ?Freakonomics, abortion, crime rate? and then ponder how conservatives want to end Reproductive Rights because their god says so).

    Conservatives also create the need for things like ?income tax?, and then are so selfish and/or ignorant about finance, that they act like taxes are a conspiracy to scam them, which has led to our current debt crisis in America.

    Analysts say a bailout fund of around $2.7?trillion would be needed if the crisis spreads to Italy and Spain, with the BBC reporting that the eurozone was debating an increase in the fund?to that amount.

    Financial markets have plunged on concerns about the ability of Europe to get a grip on the crisis.

    Deep differences remain over whether the European Central Bank (ECB) should commit more of its massive resources to shoring up Europe?s banks and help struggling eurozone member countries.

    Europe came under more pressure on Sunday when a top International Monetary Fund (IMF)?official said the ECB was the only player big enough to ?scare? financial markets which have punished many eurozone members.

    Greek austerity plan

    Greece, the country at the epicentre of the crisis, is trying to secure its latest?tranche of?funds from international lenders, including the IMF, next month to avoid a default.

    Al Jazeera?s Nick Spicer, reporting from Berlin, said: ?Greece is sticking to the plan and working with the IMF, EU and ECB and does not want to default.?

    Greek Finance Minister, Evangelos Venizelos, speaking to bankers in Washington, said Greece was determined to stay the course of its tough austerity plan to meet the terms of its bailout package.

    He complained that the outside world did not understand the severity of the measures that Greece is taking by cutting pensions, salaries and public spending, but he insisted the country will ?make it? through the crisis.

    ?Greece is not the scapegoat of the euro area or the international economy,? said Venizelos.

    Transport workers in Greece are extending their strikes ahead of the imminent visit of the IMF, EU and ECB troika.

    The subway, tram and city trains pulled to a stop, causing more headaches for commuters who had endured a strike last week.

    Newspaper headlines pondered the next move for Greece, speculating on possible ?haircuts? or even more austerity measures following meetings with the IMF, as the public said they have had enough.

    At the same time police unions, protesting cutbacks in police departments and a wage reduction for officers as part of the austerity program, unfurled a large banner over Mount Lycabettus, a popular Athens landmark, reading: ?Pay day is a day of mourning?.

    The week is expected to be riddled with strikes and protests after the recent austerity measures announced by the government, including further wage cuts, putting jobs at risk and further enraging unions.

    But the?IMF and European negotiators will not be perturbed by the strikes in Greece,?as they?are frustrated at what they say is Greece?s slow reform pace.

    After talks with IMF chief Christine Lagarde, Venizelos said that Athens will do ?whatever it takes? to reduce its huge deficit, which is currently about 160 per cent of the country?s gross domestic product.

    This week will see EU and IMF officials return to Athens to examine the country?s progress on its deficit reduction plans.

    Greece is still receiving money from an initial rescue, agreed in May last year, although it will not receive the next?round of funds?if inspectors rule that it is not keeping up with its spending cut targets.

    Many analysts say this is a real possibility, which will mean Greece will not be able to meet its debt payment for October.

    Bayer drug a "major new player" in prostate cancer (Reuters)

    STOCKHOLM (Reuters) ? An experimental drug from Germany's Bayer and Norwegian biotech Algeta that prolongs the lives of patients with advanced prostate cancer is a major step forward in treatment of the disease, cancer experts said on Saturday.

    A late stage trial of Alpharadin, a new type of drug that delivers minute, highly-charged doses of radiation to secondary tumors in the bone, was halted early after researchers saw patients on the new treatment living almost three months longer on average than those on standard treatment plus placebo.

    "It would have been unethical not to offer the active treatment to those taking placebo," Chris Parker, who led the trial at Britain's Royal Marsden Hospital, told delegates at the European Multidisciplinary Cancer Congress (EMCC) in Stockholm.

    Alpharadin is based on the active ingredient radium 223 and is designed to treat patients with advanced disease whose cancer has spread to their bones.

    Parker said he expected the drug to become a new standard treatment for these patients. Both Jean Charles Soria, a co-chair of the EMCC congress, and Michael Baumann, president of the European Cancer Organization, said Alpharadin was "a major new player" and likely to be "practice changing."

    Kemal Malik, Bayer's head of global development, has described the success of Alpharadin -- which first showed promise in headline data released in June -- as a "transforming moment" for the company.

    Sales of Alpharadin are expected to reach $662 million by 2015, according to consensus forecasts from Thomson Reuters Pharma. The drug's performance is also particularly important for Algeta, whose fortunes are tied closely its success.

    Parker said the two firms now intend to use the data to submit the drug for regulatory approval.

    TARGETED

    Alpharadin is from a class of drugs called alpha-pharmaceuticals which work by sending tiny, charged, targeted doses of damaging radiation to a secondary tumour -- known as a metastasis -- in the bone.

    Because it is so targeted, side effects are minimal in comparison with more conventional treatments, a factor that is likely to boost its popularity with patients and doctors.

    "Compared to chemotherapy, which affects all the tissues of the body, radium-223 is highly targeted to the bone metastases, and it has a completely different safety profile," Parker explained. In the trial, he said, the drug was "extremely well tolerated."

    Radium is similar to calcium in that it sticks to bone, particularly to where new bone is being formed, so it is a highly effective way of delivering radiation to a target.

    "It takes only a single alpha particle to kill a cell," Parker said. "And collateral damage is minimised because the particles have such a tiny range -- a few millionths of a meter -- so we can be sure that the damage is being done where it should be, to the metastasis."

    Parker's team studied the drug in patients with prostate cancer because it has a high tendency to spread to the bones. Around 90 percent of all men with prostate cancer will develop bone metastases in the advanced stages of the disease.

    Prostate cancer is also the second most common cancer in men after lung cancer, killing an estimated 255,000 men each year.

    Complete data from the trial showed that the median overall survival period for patients on the new drug was 14 months compared with 11.2 months for the placebo. The hazard ratio was 0.695, meaning that patients taking Alpharadin had a 30 percent lower rate of death compared to patients taking placebo.

    Why is the House of Saud risking its hard-won relationship with Washington over the Palestine statehood issue?

    Saudi Arabia, the Arab world?s richest and most powerful state, is once again at loggerheads with the United States, its longtime patron, oil customer, and weapons dealer. The current split opened with the U.S. abandonment of Egyptian President Hosni Mubarak in January and widened as President Barack Obama?s administration haltingly embraced pro-democracy demands from the Arab street ? a trend the kingdom staunchly and unequivocally opposes.

    Those differences are yet again on painful display this week at the United Nations, where Saudi Arabia will join other Arab countries ? and over 100 other U.N. members ? in supporting the recognition of a Palestinian state in the world body, a move the United States has committed itself to opposing strenuously on behalf of its closest Middle East ally, Israel.

    But Saudi Arabia and the United States have been at odds for much of the last decade, over not just Palestine but also terrorism, energy policy, and the Iraq war. The question is whether repeated strains in the relationship starting even before the 9/11 attacks are leading toward a substantive shift in the kingdom?s attitude toward its main foreign protector for the past seven decades. This is a question of major strategic importance for the United States given the kingdom?s role as the world?s top oil producer in terms of capacity (12.5 million barrels a day) and its No. 4 ranking in foreign exchange holdings ($540 billion). The Saudis continue to hold out against demands from some other oil producers for payment in currency other than the U.S. dollar, partly or totally. What would be the consequences if they agreed to a change in this policy? Is Obama willing to find out?

    The United States and Saudi Arabia have always had trouble describing how they relate to each other. For decades, the core of the relationship was summed up in the cryptic description of ?oil for security,? meaning assured Saudi oil supplies at reasonable prices in return for assured U.S. security of the kingdom against its external enemies, be it Iraq, Iran, or al Qaeda.

    In the early 1970s, the two countries coined the term ?special relationship,? even while Saudi Arabia steadfastly refused to become a ?non-NATO ally? of the United States, like Egypt, Jordan and Pakistan, or sign any formal defense agreements. After 9/11, neither side spoke any longer about a ?special relationship.? It took four years to adopt the term ?strategic dialogue,? the same used to describe U.S. engagement with China, India, Israel, Pakistan, and Russia

    The deepening divide between the U.S. and Saudi policies toward the spate of democratic uprisings in the Arab world became painfully obvious in March over the fate of the Al Khalifa monarchy in Bahrain, an island 16 miles off the kingdom?s eastern coast. Hundreds of thousands of Shiites, who constitute the vast majority of Bahraini nationals, took to the streets to demand first reforms and eventually an end to the centuries-old ruling Sunni dynasty. As U.S. diplomats urgently pressed the Al Khalifa monarchy to make major reforms, the Saudis sent in troops to help the ruling family crush the pro-democracy uprising.

    Six months later, the United States and Saudi Arabia are still at deep odds over Bahrain, while the Palestinian issue is back at the center of their differences. The issue has periodically re-emerged as a bone of contention?ever since the 1979 Egypt-Israel peace treaty left the fate of Palestinians in the Israeli-occupied territories unresolved. So have various U.S.-inspired Israeli-Palestinian negotiations ever since. There is probably more pent-up Saudi frustration with Washington over the unresolved Palestinian issue than any other in the relationship.

    It is worth remembering that Saudi King Abdullah became so furious with President George W. Bush just before 9/11 that he wrote an angry letter warning that if Washington did not do something quickly to resolve the Israeli-Palestinian dispute, Saudi Arabia intended to freeze its relations with Washington and go its own way. Bush scrambled to pacify the king, but the presence of 15 Saudis among the 9/11 hijackers so traumatized both countries that their relations effectively froze anyway.

    King Abdullah then cast about for other political and military partners that could replace the United States, engaging in an exchange of visits with the leaders of China, India, Pakistan, and Turkey. But he soon discovered that none was likely, or even militarily capable, of coming to the kingdom?s rescue the way the United States had done when Iraqi forces rolled across Kuwait to the Saudi border in August 1990.

    While the prospect for a nasty U.S.-Saudi exchange over the Palestine issue looms large, both sides have to calculate whether either can afford a major rift with the Middle East in such political turmoil and Iran pushing full speed ahead with its nuclear program.

    A rift now would, among other consequences, put in jeopardy six years of painstaking efforts to repair and repackage the two countries? post-9/11 ties. Those efforts started with King Abdullah?s much-publicized hand-holding encounter with Bush at his ranch in Crawford, Texas, in April 2005. After 22 years, Saudi Arabia sent a new ambassador, Prince Turki al-Faisal, to replace the worn-out Prince Bandar bin Sultan, and King Abdullah and Bush set up six committees to revive every aspect of the relationship, from expediting Saudi students? access to U.S. universities to deepening military and security cooperation.

    King Abdullah had even higher expectations and hopes for a new U.S. Middle East policy when Obama came into office in January 2009 promising a ?new beginning? in America?s relations with the Muslim world and an immediate relaunch of the Israeli-Palestinian peace process. His endeavor proved short-lived, however, and he lost his test of wills with Prime Minister Benjamin Netanyahu over continuing Israeli construction in the West Bank. From the Saudi perspective, Obama, for all his goodwill, had quickly failed to walk his talk.

    The Saudi king has sent several subtle indicators of his mounting anger at Obama?s announced intention to veto U.N. recognition of Palestine even as a nonvoting observer state. He has slowed the implementation of the Saudi plan to purchase $60 billion in U.S. arms, the keystone of a proposed new U.S.-Saudi military relationship for decades to come and a helpful ?stimulus package? for the beleaguered U.S. economy.

    King Abdullah has also done nothing to dissuade the Palestinian leadership under Mahmoud Abbas from a showdown with Washington at the United Nations. Nor has he signaled any difference of opinion with Prince Turki, the former Saudi ambassador to Washington, who warned in a recent New York Times op-ed of calamity in U.S.-Saudi relations should Washington veto U.N. recognition of a Palestinian state.

    So once again the Saudis find themselves staring at a test of their tangled relationship with Washington. Is a U.S. veto of a Palestinian state worth jeopardizing?the new security and military cooperation with Washington? However angry Saudi leaders are today, they have acknowledged again and again that when it comes to countering the threat from Iran, there is only ?one game in town? ? namely, the military might of Uncle Sam. Secretary of State Hillary Clinton has even suggested that the United States would be ready to establish a ?defense umbrella? overt the Arab Gulf states to protect them against a nuclear-armed Iran.

    Nonetheless, King Abdullah remains a man of high emotion and occasional spur-of-the-moment decisions, a character trait that could still produce an unexpected turn in the unsettled U.S.-Saudi relationship.

    President Obama announced Friday that he will grant waivers to states struggling to meet the high standardized test scores required under the No Child Left Behind education law.

    At least 20 states are expected to request the waivers next year. The White House says it will only grant those requests if the petitioning states agree to implement Obama-approved reforms such as evaluating teachers using their students' test scores.

    Ever since he took office in 2009, Obama has tried to get Congress to reauthorize No Child Left Behind--which distributes the lion's share of federal education spending to states. However, lawmakers have been unable to reach consensus on how to retool the 2001 law. House Republicans put forward several bills that would largely dismantle the law earlier this month, but it's unlikely that all the bills would pass.

    President George W. Bush signed the law in early 2002 as a way to hold schools responsible for low test scores and big achievement gaps between minority and white students. The law says every child must pass math and reading exams by 2014 and labels schools with students who don't improve on standardized tests by a certain percentage each year "failing." After several years of not improving enough, a school can be shut down or taken over by the state.

    Education Secretary Duncan claimed that as many as 80 percent of schools would be labelled failures under the law by 2014. Last year, 37 percent of schools were labeled as failing. Under the waiver plan, states will be asked to focus on turning around the bottom 5 percent of schools, not on every school that is called failing under the law.

    The waiver plan will let states design their own strategy for how to turn around their worst-performing schools; however, it still expects states to adopt many of the reforms Obama champions in order to qualify for the waiver.?Critics, including House Education Committee Chair John Kline (R-Minn), say this amounts to a backdoor reauthorization of No Child Left Behind. "While I appreciate some of the policies outlined in the secretary's waivers plan, I simply cannot support a process that grants the secretary of education sweeping authority to handpick winners and losers," Kline told the New York Times.

    And fans of the 10-year-old version of the education law say the waiver plan is too easy on states.

    "I'm skeptical about states' ability or will to do great reform or close the achievement gap," Margaret Spellings, George W. Bush's Education secretary, told the Washington Post. "The reason this whole waiver issue is before us is [the states] told us they were going to do something and didn't do it. And now they want a waiver against their own promises."

    Michael Petrilli, vice president of the Fordham Institute, said in an interview with The Lookout that the waiver plan represents a rolling back of the accountability measures in No Child Left Behind. "I think it's fair to say that this will effectively neuter No Child Left Behind," he said.

    But the core tenet of the law will remain intact: Schools will still be required to test their students and report those scores to the public. They also will still have to separate out how different demographic groups perform within their student bodies.
